1. Terms of Use
The following describes the terms of use on which Lads and Dads Club offers you access to our website, platform and services:
1.1 Definitions
1.1 In these terms of business the following definitions apply
“We/Us/Our” means... (Lads and Dads Club Ltd)
“You/Your” means the person who makes the booking on behalf of the people, party or entity/organisation participating in the Event, and collectively means each and every person on whose behalf a booking has been made.
“Event” or “Adventure” means the activity, function, occasion, arrangement, facility or such other service or any of them as organised by us or by members of the Lads and Dads Club.
“Creator” means the organisation or person that provides the Adventure or Event or any part of it.
“Host” means the organisation or person directly responsible for the day to day communication and management of arrangements associated with the event.
“Attendee” means any person booked to attend an Event or Adventure at some future date or time or any person currently attending an Event or Adventure that is in progress.
1.2 General
The following general conditions shall apply:
These conditions are personal to You. You shall not assign, transfer or charge your rights and responsibilities under these conditions or any of them, without Our prior written consent.
The provisions of these conditions are severable and distinct from one another, and, if at any time any of the provisions is or becomes invalid, illegal or unenforceable, the validity, legality or enforceability of the other provisions shall not in any way be affected or impaired.
The headings in these conditions are for convenience only and do not affect the interpretation of these terms and conditions.
We provide our platform, tools, and services (together, the "Platform") to you subject to the terms of service set out in this Terms of Use Agreement (the "Agreement"). Please read the Agreement carefully before registering and using the platform. By registering with Lads and Dads Club, you agree to the terms and conditions of this Agreement (the "Terms"). If you do not agree to the terms please do not register with Lads and Dads Club.
We may update the Agreement at any time. When we do, we will email you to inform you. It is your responsibility to review the most recent version of the Agreement frequently and remain informed about any changes to it. By continuing to use the Platform, you consent to any updates to this Agreement. This version of the Agreement supersedes all earlier versions, and comprises the entire agreement between you and Lads and Dads Club regarding the Platform. By accessing or using the Platform, you accept this Agreement and any modifications that we may make to this Agreement from time to time. If you do not agree to any provision of this Agreement, you should not use the Platform.
1.3 Privacy

1.4 Platform
The Lads and Dads Club Platform provides our users with a variety of resources to meet new people and facilitate groups of users meeting up and engaging in events together (an "Adventure” or an “event”).
You agree to comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of our Platform, including without limitation your participation in or involvement with any Adventures or Events or and your submission of acceptable Public Information (as defined in Section 4 ("Your Information"). You also agree to comply with all applicable laws, statutes, ordinances and regulations regarding the transmission of technical data exported from the UK or the country in which you reside.
1.5 Minors may not arrange Adventures or Events
By arranging an adventure or event you represent and warrant that you are at least 18 years old. Additional eligibility requirements for a particular Lads and Dads Club Event or Adventure may be set by the creator of the Event or the creator of the Adventure.
1.6 Membership is at the sole discretion of the Lads and Dads Club
Lads and Dads Club may prevent you from registering and attending an Adventure through the Platform at any time, for any reason, without explanation, effective upon sending written notice to the other party. We have the right, in our sole discretion, to suspend or terminate your use of our Platform and refuse any and all current or future use of all or any portion of our Platform, without notice, upon any breach of this Agreement by you which is brought to Lads and Dads Club’s attention.
1.7 Personal Use
Upon registering for an Adventure or event through Lads and Dads Club it is for your sole, personal use. You may not authorise others to attend an Adventure or Event on your behalf. You are responsible for logging out if your computer is accessible to others. This prevents unauthorized access.
1.8 Online content
Opinions, advice, statements, offers, or other information or content made available through Lads and Dads Club, but not directly by Lads and Dads Club, are those of their respective authors, and should not necessarily be relied upon. Such authors are solely responsible for such content. Lads and Dads Club does not guarantee the accuracy, completeness, or usefulness of any information on the service and neither adopts nor endorses nor is responsible for the accuracy or reliability of any opinion, advice, or statement made by parties other than Lads and Dads Club. Under no circumstances will Lads and Dads Club be responsible for any loss or damage resulting from anyone's reliance on information or other content posted on Lads and Dads Club or transmitted to Lads and Dads Club users.
1.9 Control of public information
You, and not Lads and Dads Club, are entirely responsible for all of your Public Information that you upload, post, email, transmit or otherwise make available via our Platform. We do not control your Public Information or the Public Information of or posted by other users and do not guarantee the accuracy, integrity or quality of your Information or the Information of or posted by other users. Nor do we endorse any opinions expressed by you or other users. You understand that by using our Platform, you may be exposed to information that is offensive, indecent or objectionable. We do not have any obligation to monitor, nor do we take responsibility for, your Information, public Information or information of or posted by other users. You agree that under no circumstances will Lads and Dads Club its directors, officers, shareholders, employees, consultants, agents, advisers, affiliates, subsidiaries or its third-party partners be liable in any way for any information, including, but not limited to, for any errors or omissions in your Information or the Information of or posted by other users, or for any loss or damage of any kind incurred as a result of the use of your Information or Information of or posted by other users posted, emailed, transmitted or otherwise made available in connection with our platform, or for any failure to correct or remove information.
1.10 API License.
Subject to the terms and conditions of this Agreement, Lads and Dads Club grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use any application programming interface ("API") that Lads and Dads Club makes available via the platform for the sole purpose of integrating or making available public Information on another web site. Lads and Dads Club reserves all rights not expressly granted under this agreement.
1.11 Grounds for Removal, Sanction and/or Suspension.
Notwithstanding any other provision of this Agreement, the following types of actions are cause for immediate removal, repeal and/or suspension or termination of your account:
(a) The use of our Platform to (including, without limitation, eligibility requirements):
(i) harm or intimidate another person in any way, including restricting or inhibiting any other user from using our Platform;
(ii) impersonate any person or entity (including Lads and Dads Club, Lads and Dads Club staff and other members), or falsely state or otherwise misrepresent your affiliation with any person, through the use of similar email addresses, nicknames, or creation of false account(s) or any other method or device;
(iii) disguise the origin of any Public Information that is transmitted to any third party;
(iv) advertise merchandise, auctions, services or commercial websites, including offers to trade or charitable solicitations unrelated to the topic or spirit of the Lads and Dads Club Group;
(v) resell Public Information or access to Public Information;
or (vi) collect or store personal data about other users;
(b) Posting any Public Information or other material:
(i) that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, intimidating, vulgar, obscene, profane, libelous, invasive of another's privacy (including the posting of private emails or contact information about another individual), hateful, or racially, ethically or otherwise objectionable, including any Public Information or other material that may be considered hate speech;
(ii) that is obscene, pornographic or adult in nature;
(iii) that you do not have a right to make available under any law or under contractual or fiduciary relationships;
(iv) that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party or rights of publicity or privacy;
(v) that is unsolicited or unauthorized advertising, promotional materials, or any other form of solicitation (including, but not limited to, "spam," "junk mail," and "chain letters");
(vi) that is inappropriate, posted in bad faith, or contrary to the spirit of any Lads and Dads Club;
or (vii) that uses the Platform primarily as a lead generator or listing service for another website;
(c) Encouraging others to violate this Agreement;
(d) Refusing to follow Lads and Dads Club staff instruction or direction;
(e) Violation (intentional or unintentional) of this Agreement, or of any applicable local, state, national or international law, statute, ordinance or regulation;
(f) Disclose the Private Information of any member of the Lads and Dads Club without the permission of that member;
Or (g) Transmit money to Lads and Dads Club or any Event Creator through financial accounts that are stolen, fraudulent or otherwise unauthorized.
Also, your posting of other inappropriate actions, Public Information or other materials may also warrant removal and/or suspension from our website. Lads and Dads Club reserves the right to remove any post or other material without warning or further notice.
While we prohibit such conduct and content, you understand and agree that you nonetheless may be exposed to such conduct or content and that you use the Platform and attend Lads and Dads Club Events and Adventures at your own risk.
For purposes of this Agreement, "posting" includes uploading, posting, emailing, transmitting or otherwise making available. Without limiting the foregoing, Lads and Dads Club and its designees shall have the right to remove any Public Information or other material that violates this Agreement or is otherwise objectionable.
1.12 Interference with Platform
You agree that you will not:
(a) upload, post, email, or otherwise transmit any computer routines, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
(b) interfere with or disrupt our Platform or networks connected to our website or through the use of our Platform, or disobey any requirements, procedures, policies or regulations of networks connected to our website or through the use of our Platform, or otherwise interfere with our Platform in any way, including through the use of JavaScript, active or other coding;
(c) take any action that imposes an unreasonable or disproportionately large load on our infrastructure;
Or (d) copy, reproduce, alter, modify, or publicly display any information displayed on our website (except for Your Information), or create derivative works from our website (other than from Your Information), to the extent that such action(s) would constitute copyright infringement or otherwise violate the intellectual property rights of Lads and Dads Club or any other third party, except with the prior written consent of Lads and Dads Club or the appropriate third party.
1.13 General Practices Regarding Use of Platform.
You acknowledge and agree that we may establish general practices and limits concerning the use of our Platform. You agree that we have no responsibility or liability for the storage or the deletion of, or the failure to store or delete, any of Your Information. You acknowledge that we reserve the right to log off users who are inactive for an extended period of time. In addition, you acknowledge that we reserve the right to change these general practices and limits at any time, in our sole discretion, with or without notice.
1.14 Events and Adventures
Through our Platform we provide tools that enable our users to arrange physical meetings (Adventures and Events) at venues that include, but are not limited to, public parks, private homes or private venues (such as sailing clubs, paint ball facilities, theatres etc). We do not supervise these Adventures and Events and are not involved in any way with the actions of any individuals at these Adventures and Events. As a result, we have no control over the identity or actions of the individuals who are present at these Adventures and Events, and we request that our users exercise caution and good judgment when attending these Adventures and Events.
1.15 Role of Event Creator
The event creator creates adventures and events for the use of Lads and Dads Club members. Please be aware that an Event Creator is not a Lads and Dads Club's representative or agent, and therefore an event creator may not enter into contractual relations or obligations on Lads and Dads Club’s behalf.
1.16 Role of Event Host.
The event host manages adventures and events for the use of Lads and Dads Club members. Please be aware that an Event host is not a Lads and Dads Club's representative or agent, and therefore an event host may not enter into contractual relations or obligations on Lads and Dads Club’s behalf. The event host may the same individual as the Event Creator or may be assigned by the Event Creator. The Event Host has the absolute discretion to accept or decline bookings for Adventures and Events and to define specific terms and conditions for those Adventures and Events.
1.17 Booking Procedure
We require the details as stated on our Website completed in all material respects including those that describe other individuals that are booked as attendees via your booking. In completing such details, You warrant that You have been duly authorised by or on behalf of the people, party or entity so stated and they have agreed to be bound individually and collectively by the within written terms and conditions. Subject to satisfactory details and receipt of the appropriate payments booking acceptance confirmation will be issued to You. A binding contract is in force from receipt of the payment on the within written terms and conditions.
Payments should only be received by or refunds made by or to you. Individual payments from attendees that form part of your booking cannot be accepted. If full payment is not received by the date specified by us on our booking confirmation, then we reserve the right to cancel your reservation.
The Lads and Dads Club Limited charges booking fees at the time a booking is made and additional booking change fees are made at the time a booking is altered or cancelled. These booking and booking change fees shall not be re-funded at any time.
1.18 Third Party Cancellation Policies
It is a term of Booking that You agree in addition to be bound by the Creator’s conditions, to include without prejudice to the generality of the same such matters as safety and cancellations. Activities may be cancelled due to adverse weather or other conditions, which could affect Your safety. We cannot be held liable in any event if, due to any cause beyond Our control or that of a Creator, the Adventure or Event is cancelled either as a whole or in part, for any of Your costs incurred.
1.19 Insurance
It is Your responsibility to take out adequate personal accident and travel insurance for Your protection, to include the risks of the cost of cancellation by You and the cost of medical and other treatment in the event of illness or accident. Some of the Events You wish to book may involve an element of risk.
We cannot be responsible for injury or loss suffered by You other than as expressly set out in these terms and conditions. Further, in the event You participate in events which do not form part of the Event booked with Us, this is also at your own risk and you should obtain the relevant insurance. You are recommended to check with Your Insurers that Your insurance policy covers the activities You will be participating in.
1.20 Health and Safety
You undertake to comply with all instructions and directions relating to the event received from us or any Creators from time to time and to take such other prudent steps ,so far as reasonably practicable, to the intent that the Adventure or Event may be safe and enjoyable.
Some adventure or Event activities do contain an element of risk. Lads and Dads Club is not in a position to screen for or verify the effectiveness of health and safety precautions in place at any Creator’s facility. We repeat that you do participate at Your own risk. If You have, for example, back trouble, are pregnant or suffer from any state or condition that may be aggravated by participating in an activity Event, please consider the suitability of such an activity BEFORE booking.
1.21 Disclosure
You should make full disclosure to the Event Creator of any material matters that may affect the service's and health and safety and enjoyment aspects. Some of the activities may have age, height, weight or other special restrictions. Some Events are not recommended for those with any disability, illness or infirmity. If You have an existing medical problem, allergies or disability which may affect participation You must make disclosure thereof at the time of booking the Event. In the event that You have failed to give the Event Creator this information at the time of booking, We reserve the right to cancel the booking and impose cancellation charges. Some Events may have an element of risk or danger and participation therein is at Your own risk.
1.22 Behaviour
We for Our part and Our Creators reserve the right to stop You participating in any activity or other Event in whole or in part if in Our or their reasonable opinion You are unruly, or violent, abusive ,under the influence of drink or drugs or deemed not capable to the extent that such state or condition is materially likely to endanger the safety or enjoyment of other participants, or to cause distress and discomfort and there will be NO REFUND given. We do not accept liability for the behaviour of You or others on or at the Event or if any facilities are removed as a result of Your or their behaviour.
1.23 Adverse Weather/Conditions
In the event of adverse weather conditions or other matters beyond Our control or the control of the Adventure or Event Creator, the Adventure or Event or part of it may be cancelled, postponed or delayed. In such event, You will not be able to change or cancel the Event, and We shall not be liable for any consequential loss to you. At our sole discretion, We may assist you to find an alternative Event but this may only be available at extra cost, or We may give a Credit against a future booking. We advise suitable insurance against the risk of these matters.
1.24 Photos.
All adventures and Events are held in public places and are Adventure or Event occasions, therefore all members may be photographed and such photographs may be posted on the Lads and Dads Club site by others. Lads and Dads Club reserves the right to use its discretion to remove photos from the site at members' request but are not obliged to do so.
1.25 Release.
Because we do not supervise or control the adventures and events or interactions among or between members of Lads and Dads Club groups and other persons or companies, and because we are not involved in any way with physical transportation to or from adventures and events or with the actions of any individuals at adventures and events, and because we cannot guarantee the true identity, age or nationality of Platform users, and because we have very limited control, if any, over the quality, safety, morality, legality, truthfulness or accuracy of various aspects of the Platform you agree that you bear all risk and you agree to release us (and our officers, directors, shareholders, agents, employees, affiliates, subsidiaries, and third party partners) and Organisers and their designees from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, now and in the future, arising out of or in any way connected with your use of the Platform, your Third Party Transactions, our resolution of any disputes among users, and/or your transportation to or from, attendance at, or the actions of you or other persons at an adventure or event. You further waive any and all rights and benefits otherwise conferred by any statutory or non-statutory law of any jurisdiction that would purport to limit the scope of a release or waiver.
1.26 Indemnity.
You agree to indemnify and hold us and our officers, directors, shareholders, agents, employees, consultants, affiliates, subsidiaries and third-party partners harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of your representations and warranties or this Agreement or the documents it incorporates by reference, your use of our Platform, Your Information, your violation of any law, statute, ordinance or regulation or the rights of a third party, or your participation as an Event Creator or an Event Host or in Adventures or in Events (whether the claim or demand is due to or arising out of your transportation to or from, attendance at, or the actions of you or other users at Adventures and Events). Without limiting the foregoing, you, as an Event Host or Event Creator, agree to indemnify and hold us and our officers, directors, shareholders, agents, employees, consultants, affiliates, subsidiaries and third-party partners harmless from any claim or demand, including reasonable legal fees, made by any Lads and Dads Club member or third party due to or arising out of your actions as an Event Host or an Event Creator, including your use of money paid to you by members of the Lads and Dads Club or other Lads and Dads Club users.
1.27 7. Membership Charges
Access to our Platform and use of selected features of our Platform is free. We charge fees for various premium features and services that we offer, and we will notify you of those charges at the time that we offer you the premium features or services. We may, in our sole discretion, and by notifying you on our website, change this policy and begin charging for access to our website and other features and services, and we may, in our sole discretion, add, remove or change the features and services we offer or the fees (including the amount or the type of fees) we charge at any time. If we introduce a new service, we will establish and notify you of the fees for that service at the launch of the service. If we notify you of new fees or change the fees for an existing service, you agree to pay all fees and charges specified which are inclusive of VAT for your continued use of the applicable service. We are not responsible for any charges or expenses you incur resulting from being billed by us in accordance with these Terms of Service (e.g., overdrawn accounts, exceeding account limits, etc
Upgrading to Premium membership levels is entirely at Lads and Dads Club’s discretion and Lads and Dads Club reserves the right to refuse to register any application to upgrade for any reason whatsoever.
1.28 Continuous Service Agreement
Lads and Dads Club operates a Continuous Service Agreement for our Membership Fees. This means that Lads and Dads Club automatically renews your membership when it’s about to expire. Continuous service rates apply to credit/debit card payments only and are applicable both if you join as a member online or we manually process your card details. All amounts are billed in UK sterling at the beginning of each renewal period. Your Lads and Dads Club membership subscription will be automatically extended for successive renewal periods of the same duration as the subscription term originally selected at the then-current membership subscription rate. To change or resign your subscription at any time, please see section titled ‘Termination’ below. If you cancel your premium membership, you'll enjoy premium membership benefits until the end of your then-current subscription term; your subscription won't be renewed after that term expires. However, you won't be eligible for a prorated refund of any portion of the subscription fees paid.
1.29 Event Charges
(a) In addition to the Premium Membership Fees there may also be additional charges for some adventures and events or services which a member wishes to apply for. When booking an adventure or event you must pay the full amount for that adventure or event on the internet. Alternatively if we have your verbal authority to deduct payment from your credit/debit card over the phone it is understood that you have accepted our terms and conditions. We reserve the right to charge an ‘offline’ price for manually booking members on an event if booking is arranged over the phone or email instead of the member booking themselves on the event online. This may be higher than the advertised price. These terms and conditions together with the general information provided on the Platform for each individual adventure and event is the basis of your contract for each adventure and event
(b) You are responsible for ensuring that you are at the correct meeting venue for the adventure or event at the correct time, as we cannot be liable for any loss or expense suffered by users because of their late arrival. It is your responsibility to ensure that you adhere to all instructions and Regulations provided by the Event Host or by Lads and Dads Club.
(c) It is possible that circumstances may force Event Hosts or Lads and Dads Club to make changes to the adventure or event. These changes will fall into two categories:- minor changes and major changes. Minor changes take the form of changes in meeting times, changes to meeting venue, or changes to a similar location. Major changes are those including changes to meeting time by more than 12 hours. If the Event is one that incurs an additional fee (beyond Premium Membership fee) in the event of a major change you can continue with the Adventure or Event as amended, accept an alternative Adventure or Event we may offer you or cancel your booking getting a full refund.
(d) Your booking for any Adventure or Event that incurs an additional fee cannot be exchanged, transferred or resold and will be subject to the Regulations applicable for that Adventure or Event.
1.30 Cancellation charges
When booking onto Paid Adventure or Events organised specifically by Lads and Dads Club, please be aware that one of the following late and non-cancellation policies shall apply:
a. Lads and Dads Club Adventures or Events
(i)If a member cancels their place to a Lads and Dads Club Adventure or Event they are due to attend less than 48 hours before the start time of that Adventure or Event OR if a member does not cancel their place to a Adventure or Event and does not attend the Adventure or Event, no refund of charges shall be made.
Or (b) Non Lads and Dads Club Adventures and Events
When Booking onto Paid Adventures and Events not specifically arranged by the Lads and Dads Club the following cancellation policy shall apply;
(i)Booking charges are not refundable
(ii) Event charges levied by the Adventure Creator or Event Creator may be refunded or may not be refunded in accordance with the refund policy applicable to that Adventure or Event.
1.31 Refund Policy
Access to the majority of the Platform and registration to become a Lads and Dads Club user is free.
(a) All Premium Membership Fees are non-refundable. Cancellation and/or termination of membership for any reason does not entitle the user to any refund.
(b) Upon booking your place at a Adventure or Event that incurs a fee beyond the Premium Membership fee, the relevant fee will be accepted through the payment gateway provided via the Lads and Dads Club website.
If less than 6 people have registered to attend a Adventure or Event that has been organised by Lads and Dads Club adminstrators alone, not those organised by third party Event Creators, you will be informed up to 4 hours before the Adventure or Event, and Lads and Dads Club will give you the option to transfer to another Adventure or Event of the same fee value, or will refund your paid fee in full within 14 days.
If you cannot attend a Adventure or Event, that has been organised by Lads and Dads Club Administrators alone, not those organised by third party Event Creators, that incurs a fee beyond the Premium Membership fee, and only if, you provide Lads and Dads Club with your notice of cancellation more than 7 days before the Adventure or Event is due to take place, you will be provided with a 100% refund within 14 days.
Alternatively, if you cannot attend a Adventure or Event that you have booked your place on, that has been organised by Lads and Dads Club Administrators alone, not those organised by third party Event Creators, and only if, you provide Lads and Dads Club with your notice of cancellation more than 7 days before the Adventure or Event is due to take place, subject to places being available, you will have the option to transfer onto another Adventure or Event to the same fee value or less, with the difference being refunded within 14 days.
If less than 7 days notice of cancellation is provided, no refund will be provided but it will be at Lads and Dads Club’s discretion to transfer you onto an alternative Adventure or Event to the same fee value or less.
1.32 Termination
A Member may terminate their membership with Lads and Dads Club at any time:
You can cancel your account by emailing support@Lads and Dads Club.com with REMOVE in the subject line. Please include your full name and reason for leaving and we will aim to cancel your membership and remove your profile within seven days.
You can cancel your Premium Membership subscription via the Settings area of the site. If your request for termination is received before your next payment is due, your Premium Membership status will last until the end of the original subscription period paid for.
Lads and Dads Club may terminate or suspend the membership of any Member at any time for any reason whatsover.
1.33 Proprietary Rights
Lads and Dads Club owns and retains other proprietary rights in all services offered by Lads and Dads Club. Lads and Dads Club contains the copyrighted material, trademarks, and other proprietary information of Lads and Dads Club, its licensors and licensees. In addition, other Members may post copyrighted information, which has copyright protection whether or not it is identified as copyrighted. Except for that information which is in the public domain or for which you have been given permission, you will not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. By posting information or content to any public area of Lads and Dads Club, you automatically grant, and you represent and warrant that you have the right to grant to Lads and Dads Club and other Lads and Dads Club Members an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, perform, display and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sub-licenses of the foregoing.
1.34 Information supplied by member
Lads and Dads Club will keep confidential all information supplied by you to Lads and Dads Club, and shall use or disclose such information only for the purposes for which such information was collected, or as required by law. A statement of our privacy policy may be found athttp://www.ladsandadsclub.com/privacy.
1.35 Complaints
To resolve a complaint regarding Lads and Dads Club, you should first contact Lads and Dads Club Customer Support via email to contact@Lads and Dads Club.com.
1.36 Disclaimer
Lads and Dads Club does not have the ability to independently screen participants registering as members or to attend its organised Adventure or Events. By registering to become a user or to attend a Adventure or Event through Lads and Dads Club, you are agreeing that neither Lads and Dads Club is liable for any damages, direct or indirect, that may in any way arise out of Lads and Dads Club’s Platform. This includes, without limitation, damages arising out of travelling to and from a Adventure or Event, meeting or communicating with other participants and the actions of other participants in programs sponsored by Lads and Dads Club.
1.37 Disclaimer of warranty
Lads and Dads Club provides service on an "as is" basis and grants no warranties of any kind, expressed, implied, statutory, in any communication with Lads and Dads Club or its representatives, or otherwise with respect to the service. Lads and Dads Club specifically disclaims any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Lads and Dads Club does not warrant that your use of Lads and Dads Club will be secure, uninterrupted, always available, or error-free, or will meet your requirements, or that any defects in the service will be corrected. Lads and Dads Club disclaims liability for, and no warranty is made with respect to, connectivity and availability.
Limitation of liability: In no event will Lads and Dads Club be liable to you for any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of data, loss of programs, cost of procurement of substitute services or service interruptions) arising out of the use of or inability to use the Platform, even if Lads and Dads Club or its agents or representatives know or have been advised of the possibility of such damages, or to any person other than you. Notwithstanding anything to the contrary contained herein, Lads and Dads Club's liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Lads and Dads Club for the service during the term of membership.
Lads and Dads Club does not screen the members registering for services offered by Lads and Dads Club in any way. As a result Lads and Dads Club will not be liable for any damages, direct, indirect, incidental and/or consequential, arising out of communicating and/or meeting with other members of this service, or introduced to you via this service. Lads and Dads Club is not liable for the integrity of statements made by members as to their identity and general background. It is incumbent and advised upon the user to verify any and all information relating to but not limited to this subject. It is advised to check references of any user.
Nothing in this agreement shall exclude or limit our liability to the user for death or personal injury resulting from the negligence of Lads and Dads Club or that of the employees or agents of Lads and Dads Club or any liability which is due to our fraud or any other liability which we are not permitted to exclude or limit as a matter of law.
If any term is held to be invalid, unlawful or unenforceable, it shall not affect the enforceability of any of the remaining terms.
1.38 Jurisdiction
This agreement shall be construed in accordance with the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction to deal with any disputes arising between you and us or our suppliers
